A human rights approach integrates the norms, standards and principles of the international human rights system into legislation, policies, programmes and processes. The concept of a ‘right’ means that it is a legally enforceable entitlement, which the government is obliged to respect, promote, protect and fulfil. This concept means that those not enjoying their rights (such as people who have been trafficked) must be given an opportunity to claim them. It also means that, if their rights are violated (as they are when trafficked persons are under the control of a trafficker), they are entitled to restitution – the State takes action to put them back into a situation that is at least as good as it was before their rights were violated. A human rights approach places people and their human rights at the centre of the agenda.
